Waiver of Liability: I, the undersigned, understand that outdoor pursuits are hazardous activities and that even the correct selection, use and maintenance of outdoor equipment cannot eliminate the risk of serious injury or death. I also understand that I am responsible for my own actions and decisions and for familiarizing myself with the capabilities and limitations of the equipment I check out from the Outdoor Program (the “OP”) of Colorado Mesa University.
I assume all of the dangers and risks arising from the outdoor pursuit in which I am participating and from the selection, use and maintenance of the equipment that I check out from the OP (the “Rented Equipment”). I expressively agree to waive and release all claims that I may have against Colorado Mesa University, its trustees, officers, agents, representatives and employees, including claims for property damage, bodily injury, or death resulting from the outdoor pursuit in which I am participating and from the selection, use and maintenance of the Rented Equipment. I also expressively agree to indemnify and hold harmless Colorado Mesa University, its trustees, officers, agents, representatives and employees from all liability for property damage, bodily injury or death, whether arising from their negligence, strict liability, breach or warranty, or otherwise to me or to other persons, directly or indirectly resulting from the selection, use and maintenance of the Rented Equipment.
Equipment Selection & Condition: I will carefully inspect the Rented Equipment and acknowledge that it is of the type, size and design selected by me, and that I will use the Rented Equipment only if I am satisfied with its condition.
Damaged Equipment: I will return the Rented Equipment clean and dry and in the same condition that is was checked out to me. I further agree to pay the OP for the costs for the repair or replacement of any and all damage to or loss of the Rented Equipment. I understand that when the Rented Equipment is returned by me, it may be inspected after I leave the OP office.
Late Fees: By signing this Agreement, I agree to pay a fine based on the current regular rental rates posted in the OP office if the Rented Equipment is returned later than the Due Date.
